PBM Accountability Project Statement on House Introduction of Critical PBM Reforms

Representatives Mariannette Miller-Meeks, M.D. (R-IA), Nannette Barragan (D-CA), Nicole Malliotakis (R-NY), Brad Schneider (D-IL), Rick Allen (R-GA), and Donald Norcross (D-NJ) today introduced the Delinking Revenue from Unfair Gouging (DRUG) Act, which would implement de-linking policies to require PBMs to charge a fixed fee for their services. This approach would replace the current practice where PBMs are allowed to charge a percentage of a prescription drug's list price, aligning their incentives with higher drug costs.


Mark Blum, Managing Director of the PBM Accountability Project, issued the following statement:


"This bipartisan legislation tackles head-on the current perverse incentives that motivate a few dominant PBMs to exploit the drug pricing system for profit at the expense of patients by finally severing the connection between PBM compensation and the price of medicine in the private marketplace. It prevents PBMs from deriving income from any source other than transparent, market-determined fees for bona fide services that are valued by their clients. We commend Representative Miller-Meeks and her co-sponsors Representatives Allen, Barragán, Malliotakis, Norcross and Schneider for taking this meaningful action."
